 I don't understand what your question is. Could you make your question easier to understand and offer a sample move [one that's preferably in Algebraic notation]?

 I think he means black could play ...Qa5.  That's true, black could.  But Qxd3 is simpler and wins a piece.  I know which move I would play - and did play in solving the puzzle! :-)
