Does this site have the ability to see when a position has been achieved three times on a board? Because I dont think he is going to accept a draw and there is no point to dragging it out.

You have to explicitly claim it by clicking on the CLAIM DRAW button ... http://www.chess.com/forum/view/help-support/3rd-repetition-not-flagged-as-draw
