I have a game against Bapooya.  On my 40th move, the computer should have flagged it as 3rd repetition (36...Kf7  38.Kf7  40.Kf7) or 3rd identical position.

I am not knowledgeable on how to claim a draw in this website.  I assumed that  the computer would know when a 3rd identical position has occurred.

In this case, the computer seems unable to detect a 3rd identical position.

May I inquire on how I can claim a draw should a situation arise where my next move would create a 3rd identical position?

Thanks for your help

The "Offer Draw" button changes to a "Claim Draw" button whenever a position repeats itself for the third time. However, if the game deviates from this position, the claim draw button goes away and you can no longer claim a draw.

That is correct. But my opponent made his made immediately as soon as I made my move so that when I clicked on the claim draw button it was an offer draw button.

Sorry. :) You gotta be quicker on the claim draw button for now. We don't know of any other solutions at the moment.

I haven't encountered this in my games at chess.com, but the rule is that a player who is about to make a move which would repeat the position for the third time can claim a draw.  He doesn't actually make the move.  Not sure how that would work online though...

So, if my next move will create a 3rd identical position, can I ask this website to intervene and declare the game a draw?

yes. On the game view page, as soon as you move, go to that game and click "claim draw" and game will end.

Yup, I got me a nice claim draw one time. My king hunt turned in a stroll around the park holding hands.

I guess Online chess can not duplicate OTB chess where a player does not have to make a move when he claims the draw.

Of course, there is a way for online chess to duplicate (as closely as possible) the OTB rule:  Make the button of the player whose turn it is change to "Claim Draw" any time there is a legal move which would result in threefold repetition.  That way, if I intend to claim the draw I can click the button to announce that I intend to repeat the position.

Question.  If the player has many moves, but purposely moves say his king to the same spot three times, is that a draw even though he could move to other locations.

Three times the same position is a draw, it doesn't matter why the position gets repeated. It doesn't need to be in three consecutive moves either.
