Hey need some help here from one of the staff or you. I don't know if this is the right place to post it here. Well I am pretty sure this ' game' is a draw. As you can see in the last few moves is was the same for more than 3 times so I believe is a draw by perpetual check or repetition ? Could one of the staff have a look at it please and have that as a draw.

Before the last move (the king move) it was a draw by repetition but ONLY if one of the two players claims it. It is NOT automatic.

Check under the message board/details/moves/etc box, you should see a clickable option for "draw" or "declare draw" or something like that.

He can't refuse ... it only takes ONE player to claim. The other has no rights if 3-fold repetition of position is on.

No.  What they were saying is that, once the conditions for 3-fold repitition are met, then pressing the 'Draw' button will claim the draw for you.  Your opponent would not get an opportunity to accept or refuse it in that case.

I know that now....but what i don't understand is that in previous game when we have insufficient material to checkmate is become a draw and it came out automattically and why not the same thing for the repetition and others ?

Neither side can possibly mate when there is insufficient material, so a draw result seems pretty much obligatory.  The rule for 3-fold reps is essentially the same as in tournaments, i.e. you have to claim it.  By the way, the same is true for draws by the 50-move rule - you have to claim it to get it.  (The chess.com software does give an automatic draw if you click on the draw button when a draw claim by the 50-move rule is valid.)

Kelvin, why did you resign that game? I think that was supposed to be a draw!

Why? because the Laws of Chess state that a draw by repetition MUST be claimed, the rules specifically state that that type of draw is not automatic. It's theroitically possible that that condition might occur, and neither player actually wants to draw.

...which you didn't do. I think we all get it now, and I hope you don't still have a provlem with this, though his insistence for you to resign was not right of him.
