The first picture was taken at 6:00 pm, the sun was not very hight but still was shining pretty well. The moon was already VERY high so that's why nothing blocks the view.

The second picture was taken at 22:00 pm...

Its definitely waxing.  But how was the blue background picture taken?  If its that light, the sun must still be fairly high.  But then the moon is just rising and the trees, houses, horizon block the view...

Both moons are touching the right border of the picture.  Very clever.
