It can be gotten out of, but actually, the alternative for black is not very happy either, because even if black sees the trap, he has to check with the queen. If you block the check with your queen, black basically has to exchange which clearly benefits you--being up in material. Because of that, I would say a !? might not actually give white enough credit; there isn't a lot that is uncertain or risky about the move, I only really see upside for white.

Sometimes the annotations are suited to the level of those playing. In a GM game, I don't know if it would merit any special annotation, but in a low-level match like one of ours, I might give the move a !
