Perhaps OP feels Black should not be allowed to castle in general?

It should be noted that it doesn't matter if the rook is being attacked or passes through an attacked square. That restriction is only for the king.
If you have an example where the king or rook used to castle had already moved or the king castled into, through, or out of check, then you should provide a link to the game.
