More like Earth is now moving closer to voyager 1 as it comes around the side of the sun in its direction. Earth's Orbital speed of 67,000 mph exceed the crafts speed of 38,000 mph, so for 1/4 of the year it actually gets closer. Notice the distance starting to decrease on the live tracker.
