Why not 5. Bxf7+
This would force the King to d8 or e7 and not allow for the development that is proposed.

This would force the King to d8 or e7 and not allow for the development that is proposed.
Black plays 5...Kd8 and White is more or less forced into sacrificing his Ne5 for the two pawns he has captured by 6. 0-0 (which eliminates the threat of ...Qxg2) 6...Qxe5. The position after 7. c3 Ne6 and either 8. Re1 or 8. d3 might still be playable for White, but he had far better choices on move four than 4. Nxe5?! the most simple being 4. Nxd4 where after 4...exd4 5. 0-0 a position similar to Bird's Defense against the Ruy Lopez has arisen (http://www.chess.com/opening/eco/C61_Spanish_Game_Bird_Variation) except because White's bishop is on c4 instead of b5, if Black plays ...c6 it does not gain a tempo by kicking said bishop.
