It doesn't matter. The minter of the NFT doesn't own the image, only the position in the database.

I'm still not getting the whole NFT thing. I've read about it, people have explained it pretty well, but my own inability is keeping me from understanding it. So you are saying it literally doesn't matter if someone takes a picture, since it's not copyrighted? Only the "position in the database" matters? I don't see how something like that has any value.
Somewhere else someone mentioned a grandmaster game, which I believe could have value. So if I understand this (which is unlikely) the game itself, or a record of it like notation or picture or video, is totally seperate from a NFT?
I've read about many golf pros now participating in NFTs. Mostly things like photos and autographs. So I assume this same weird situation applies. Nobody is getting an autograph or picture, they are getting an "NFT" instead?
