They are allowed because, unsurprisingly, the players get to choose their moves.
Obviously but perhaps the 3 move rule should be disabled for the first couple of moves or something. Then of course you can perhaps repeat a move 20 times to get to it, which would need to be addressed.
All I'm saying is it doesn't seem right they can get out of the game in such a position at the beginning.
Well, threefold repetition is disabled for the first couple of moves by its nature.
At the point the player have to decide between playing a move which can repeat, or giving themselves a worse position. What choice do you expect them to make?
And yes, you've refuted your own idea. If it repeats 3 times, they can repeat it 20, and what have you achieved?

if they both agree it is a draw there are no acceptable rules to be made to prevent them drawing.
