Chess.com Violates California Law

Anybody who wants to sue chess.com is a stinking skunk

I just find it interesting that our so famously correct and brave OP has disappeared and refused to talk about anything I said... maybe an admittance of defeat? I was excited though, I like a good debate and they seem like they're decently knowledgeable.

Oh I’m still here. So chessnut4444, I guess you’re never learned about how laws across states and countries work and that’s OK but you just can’t invent your own version and declare it to be accurate just because I’m not here 24/7 to prove you’re wrong. But you’re completely wrong. Very misinformed you are indeed. Shouldn’t a state or country decide its own laws? In fact, that’s exactly what happens. And if a neighboring state or country wants to do business there, do you really think a government is going to say, oh well we see you don’t live here so all those laws we have, well, they don’t apply to you. Um, NO. When Chess.com does business in California, they are subject to California laws. It doesn’t matter that they are located in Utah. If they are doing business in California they need to follow California law. In fact California requires every business (other than sole proprietorships) to actually register with the state. Here’s a quick quiz for you… what business is registered in California with #201307110200 ?? Why, it’s none other than Chess.com LLC! Next question, what popular Chess website has these three sections within its terms of service: 8. California Privacy Rights Act (CPRA) 9. Additional Information regarding Personal Data processed subject to the General Data Protection Regulation (GDPR)10. Other Region and State-Specific Terms. If you said Chess.com, you’re correct!! But why would they have special terms for California, the European Union, and other states?!?! That’s a lot for some fellas in Utah to keep track of! So despite this clear evidence that Chess.com is subject to California law, and the fact they are registered to do business in the state which certifies they will comply with such laws, and have adapted their terms of service with special section that ensures compliance with California laws, as well as the fact that this is fairly common knowledge about how legal jurisdiction works, and can be verified by you and everyone else in two minutes using google, I guarantee some people here will remain unconvinced, they’ll tell me I’m wrong and that David, someone who apparently can’t even read, is “owning me” LOL that one truly did make me laugh out loud. Bring it, ignorant people. There’s no laws against being ignorant and besides they ARE based in Utah, so yeah.

That post was for you Cold_W1nter not chessnut4444. Apologies. Cold1Winter thanks for describing me as “famously correct” and “brave.” It means a lot. I will admit defeat when I’m wrong but at least give me 12 hours to stop crying and make a generous charitable donation to Chess.com before you declare victory not based on 2 minutes of using Google to check on basic facts, but because I’ve “refused” to talk to you. Waiting a reasonable amount of time would make your passive aggressiveness really shine. “Oh what a pity without an instant answer I must be correct, I must have really put him in his place haven’t I, well, too bad I would have really enjoyed debating he of such such decent knowledge and I, with my superior knowledge which I pulled out of my arse sitting on the beach in Hawaii, oh yes his silence is quite strange indeed how long has it been now, five minutes?”

@theswooze David doesn’t actually own me...his family secretly pays me to help out and I’m glad to do it. Look man if I wasn’t around to help, the guy could barely function. He can’t even read!!

@Mittttens What’s it like, being the four t mittens? Obviously two t mittens was taken, and someone just a bit more clever was fast to grab the three t mittens, but hey at least you got four. Theoretically is there a cut-off to the number of t’s your ego would allow, or were you determined to be a mittens even if it was like the 8 or 9 t mittttttttens or mitttttttttens?

@NicholasOssine Yo it’s also hella educational too 🍁

@theswooze Thanks, usually I just say something about being good enough and smart enough or whatever. You seem really cool.

Hi Martin since you’re obviously reading the thread and investigating people, any updates regarding when Chess.com will start to send renewal notices in California? Any news regarding an update to the terms and conditions? If refunds are given, why do you continue telling customer the opposite?

I have no knowledge of the processes that may or may not already be in place for CA members or plans to change how it works if the process for those members are not in compliance. I know the site has legal resources, so likely already has that in their radar or are already in compliance.

Easy solution: just don't take payments from California residents automatically and suspend their memberships (and all the privileges attache thereto) until they renew on their own.

California doesn't like you either.

The court finds Chess Dot Com innocent by reason of insanity! @Spawney is hereby ordered to pay Chess Dot Com all the disputed membership premium!

Next case. @Spawney verses Big Oil!
