Could "Drawn by repitition" be punishable?

Hi all. I just lost a game this way: http://www.chess.com/livechess/game?id=1205911887

Wich for me seems very unfair, as instead of winning points i got -1, wich is exactly what he wanted. I could not do anything to get out of that position and I didnt want to resign there.

Could there not be an algoritm to detect wich player started the repetition or something, give minuspoints to him and 0 to other player for instance?

the gmae was drawn. You didn't lose. you got minus 1 since you were higher rated then your opponent. If your opponent was 1100 rated you would've gained 1 point in the same position

Whether you gain or lose ratings points from a draw is affected only by whether your initial rating was lower or higher than your opponent's initial rating. The manner by which the game was drawn makes no difference.

The idea of penalizing the person who "started" the repetition is silly-- the draw by repetition rule is a feature intended to be exploited by either player if they find the option useful. And it is an option-- draw by repetition is not automatic, but has to be claimed by one of the players. In your game either player could have invoked the claim several moves earlier.

You had more than one opportunity to exchange queens with a big material advantage. You should do that specifically so as to avoid repeated checks. Legal moves should never be punishable.
