yes cheating in live chess, but part of the rules in online chess.

I don't think its cheating in either.  Every game at our level will leave opening theory relatively early so it doesn't do one any good to refer to it anyway.  I use it occasionally in online chess when I see an unorthodox move in the opening.  So is it cheating?  I say no.  But it won't help you get better.

The principle is that live chess is like OTB play, so referring to anything other than your own noggin is out. This is fine in correspondence play though.
