Seems like a real cheesy thing to do. You could have all your pieces while your opponent only has his queen left and still theoretically end up in a draw.
IMO if a player checks his opponent more than 5 times with the same piece in a row, he should automatically lose.
I don't know how that justifies a draw when it's CLEARLY not.
You are perfectly entitled to set up your own website, invent whatever rules you like for a new game and try to find people to play according to them. Here, you are obliged to play according to the rules of chess.
chess.com can not practically implement all the laws of chess (see diagram below, software probably can not see this is a draw), but they're doing good job in trying to implement most of it.
This is draw only by 3-position repeat or 50-move repeat without capturing a piece and without moving a pawn.
Atleast in turn-based you get a new option of "Claim Draw", and if you click that without your opponent's approval, the game would become draw.

Your point is valid but of rather little importance, as it can only affect the result when one player plays suicidally or runs out of time (where there is no more reason to be aggrieved than when losing a winning position on time). The situation of perpetual check (dealt with on chess.com simply by agreement or through the application of the 50 move rule) is one which determines the value of positions with best play, so is of fundamental importance.

Play Chinese Chess, if you perpetually check the opponent's King, you lose. Lol.
I haven't played chinese chess. I tried to learn online once. I realized, unless someone teaches me it may be difficult for me to learn it.
