That's not true at all. Why don't you look at how the rules have changed over the years first. This "fivefold repetition" rule was only made in 2014!

The first edition of the FIDE rule from 1928 already defines the threefold repetition rule without considering castling and en passant capture rights.[29] To additionally consider castling and en passant capture rights was implicitly introduced in 1975[31] and explicitly worded in 1985.[33] Prior to that, a 1964 FIDE interpretation established the same (Harkness 1967:49).

It makes no sense if you think of chess as a war, but if you think about the rules, it makes perfect sense. No legal move can be made. If stalemate were a win you would be able to checkmate with only a queen. It' you

#1, so you're basically saying that the rule "The king cannot move into check" is stupid.

The way I think about it is: you aren’t allowed to pass your turn. If you can’t make a move, you sit there at the board for a very very long time and you can’t do anything until you and your opponent agree to a draw. Stalemate speeds up that process.
