May I suggest a simple possible solution to the loophole in the FIDE Laws of Chess.

Here is the section in the rules.

9.6 If one or both of the following occur(s) then the game is drawn:

9.6 If one or both of the following occur(s) then the arbiter may declare the game drawn at his discretion:


9.6.1 the same position has appeared, as in 9.2.2 at least five times.

No change


9.6.2 any series of at least 75 moves have been made by each player without the movement of any pawn and without any capture. If the last move resulted in checkmate, that shall take precedence.

9.6.2 any series of at least 75 moves have been made by each player without the movement of any pawn and without any capture.

Last sentence in the above rule was removed, because the arbiter claims.

 

Now the rules are just like claimed, but claimed by the arbiter at his discretion.

For 3 fold and 50 moves a player claims, but at the players discretion.

For 5 fold and 75 moves the arbiter claims, but at the arbiters discretion.

For online play the chess website is the arbiter, they just leave the rule, in the program code, as it is, the program code (arbiter) claims the draw for 5 fold and 75 moves providing that the final position is not checkmate.

Loophole closed.

Conclusion

In summary the changes that could be made to simplify the repetition rule are as follows:

A draw claim is not also a draw offer.

A position is considered to be the same if the position on the board is identical with the same player to move.

En passant capture rights is not considered, any changes in these rights is ignored.

Permanent castling rights is not considered, any changes in these rights is ignored

Only positions that have occurred on the board are considered, a player does not write a move on the score sheet before calling the arbiter without actually playing the move.

If White (Black) plays a move and wants to claim a draw, he stops the clock and calls the arbiter.

If White (Black) plays a move, does not claim, and presses his clock then Black (White) can stop the clock to claim.

5 fold repetition is no longer an automatic draw, the arbiter claims the draw to stop perpetual games, this closes the loophole that is present in the FIDE Laws of Chess.

He is just insulting me, being rude.

He does not know that I was a strong player, but that I no longer play.

I guess he never saw my topic for a game that I played that is on my profile.
