If staff or moderators remove your profile it must have been against the avatar guidelines

no, that isnt what i mean. there's someone copied my pfp. then they set it as their pfp

I mean, unless you own the exclusive rights to it and it's trademarked in the U.S. which is where Chesscom is based. You can't really take any legal action, whether it be moderative or enforced through other measures such as fines.
I'm not too sure about this, but I'm fairly confident about parts of this message. Like the parts about copyright and enforcing. Otherwise, you can definitely sue for copyright infringement.
And that's why you can't really do anything about it and just have to forget about it lol. Change your own avatar if it's really annoying you.
I'm neither a lawyer nor a legal consultant, and you should reach out to staff if you think that you do have the appropriate evidence to remove their avatar. But there's also things like Terms of Service on some platforms that make you release the things that you publish under a certain CC license, and then anyone else has rights to use it themselves.

Generally speaking, unless it's completely original art or a personal photo you have sole rights to, there's not really anything against that unless they try to impersonate you.

If it is a completely original image or photo then you could contact support about it.
