A friend of mine had the same experience, but chess.com closed the cheater's account. It sometimes takes awhile, but they will close them and put the ELO points back. The W-L record stays, but a big red X shows your opponent violated fair play rules, so it's no big deal.
I had still 4 daily games open with someone whos account was closed. I got the option to claim the win. What happens to my rating if i decline to claim the win?
(For another game with that same person, chess.com gave me compensation on the rating. But that game was finsihed already)

If you don't claim it will automatically claim after 60 days from running out of time (bring in the auto-claim state)
As long as at least 4 moves have been played by both players, you'll gain rating if the Gabe's are rated.
Lost 2, drew 1. Daily chess. Account closed due to fair play and I have not been credited for the rating points. I reported the games at the time because this person was a clearly a cheater/sandbagger and I unluckily got matched to them 3 times in daily back to back. I can provided additional details but I think these losses should be struck from my daily record.
