Modern en passant. You can't actually capture the pawn but you can move to the en passant location if it's not on consecutive moves or files.

That's not really the idea. There shouldn't be issues like this often. On most sites, when you go all the way down the page there should be a 'Contact Us' or 'Help & Support'.
Well the guys from the site should know it as well, because I tried to move my pawn where you've shown but I was unable to move. Probably I am going to lose on time :)
You click on "help and support" at the bottom of the page; now click on "Contact Support"; now select "technical support and bug reports"; then fill in the details requested and submit what gets called "a ticket".
Wait (not too long usually, maybe a day or two) for a reply.

Kohai, I just checked the game. Well it is still the same - still it is my turn. As you suggested I offered a draw, so it is a pending offer. The opponent name is Groucho10.
