Curious Positions

Take a look at this diagram. Is it checkmate for White or is it mate in one for Black? It's one of those curious positions which aren't always as clear-cut as they first appear. White's last move was obviously 1.e4(#), but where was the pawn before then? If it was on e3 then it is checkmate, but if it came from e2 then Black has the en passant capture 1...fxe3#!

Or how about the next position (don't worry about whose turn it is)? Is it checkmate for White or is it checkmate for Black? Of course on the surface it is surely checkmate for White, but there are no co-ordinates on the board which means if you flip the board over it now looks like checkmate for Black!
