The 50-move rule and the 3-time repetition rule require you to hit the "Claim Draw" button. They won't fire automatically.

Yep, when a draw is available, the Offer Draw button changes to Claim Draw. The idea is that just as in OTB where you need to take action and call the TD over to verify it, chess.com wants you to take an action rather than just award it to you. I agree it's a little silly and confusing since there are sites that just award it to you. Still, them's the rules and there is logic behind it.
To be honest i pushed the draw button and the guy declined...:(
So , to conclusionate this, after fifty moves, if i had been pressed the draw button, the site would reward me with a draw game ... ??
The idea is, that was pressed by the time, and hadnt time to count my moves.....i think that it should end in a draw automaticly by the site rules. Anywayz i will take this into consideration and spam the draw button like mo' f****r next time.

It should, yes. As long as the conditions are met, it will be treated as a draw claim, not a draw request.
I don't think you need to keep banging the Offer Draw button. As I said, the button itself changes when there is one to be claimed. If I remember right, the color changes too, but don't hold me to that.
Here's the article on it. I guess the button only changes for "daily" chess; in Live you do have to keep hitting the Offer Draw.

It also depends on when he clicked the draw button.
Keep in mind, it's 50 moves by each player, not 50 total, so if you clicked it after Black's 67th move, it's merely an offer.
For the claim to go thru, Black would have to have made his 92nd move, since the last pawn move or capture before that was Black's 42nd move. If you did it after White's 92nd move or earlier, it's merely an offer, or if you wanted until move 106, since a capture then occurred.
My guess would be that you either did it after your 67th move, which is 25 moves, not 50, or on your 92nd move, where you hadn't made your 92nd move yet when you clicked the draw button. At that point, it's merely a draw offer as both sides hadn't made 50 moves without a capture or pawn move. White at that point has made 50, Black only 49. Black would have to have completed his 92nd move, and then make the claim when it's White's turn to make his 93rd move.
