We just don't count the points from the games with cheaters involved. If it is an under 5 player match we are voiding the mach 100%

Yes, it'll be Voided because there isn't 5+ players. However, we can make exceptions for the Nickolay case.

So divyaujjwal told me that you now can only decline a battle when you have at least three battles. Is this the case?

Yes.
The rules have been adjusted to a max of 4 battles on one territory. You may decline if you have 3 already.

This isn't the correct thread for such a question.
My advice, though, would be to ignore such accusations.
If you do need to take off and won't be able to come back you may just want to offer a draw or resign. That way your account won't be suspended.
