While the precise form of the Uniform Commercial Code varies from state to state, the language of their initial disclaimer typically would disclaim implied warranties of merchantability and fitness for a particular purpose, but not any express warranties. Express warranties would include that it's a chess set, and that it looks like the pictures they provide and has 32 or 34 pieces, and that the pieces are not broken. Any attempt to disclaim such express warranties typically would make the sale voidable notwithstanding their disclaimer language because enforcing it would frustrate the essential purpose of the sale. I provide this by way of explanation, not to offer anyone legal advice.

Let's update, received my set today as some other have also. I ordered one set of Rosewood/Boxwood. For sure worth the $59.95. Now I will state MY opinion of pros & cons as I unpacked the set. I stressed MY because opinions are cheap, everyone has them.

PROS:

Nicely weighted, the box had a label triple weighted and I beleive this to be true.

Rosewood is very dark and uniform which is nicely done...beats getting varied rosewood for different pieces making it look lik it came from a few different sources.  Very rich looking, well done.

Quality workmanship.  Can't finish/turn/carve the pieces much better than they are.  Bishop & Pawns are almost exact to the original.

Cons..Why have a label on the box stating the size is 3 7/8 and then advertise it as a 4". that was a little puzzling but not critical and maybe picky.  Queen when compared to the original small club set is way off in collar, top, crown.  Rook is much larger in the new set but I actually like that, Knight is a bit smaller in the new set.

All in all a super buy at this price.  If CB comes out with a 4.5" and 4" and makes the **Queen/Knight/Rook the way the original sets from the 30's  & 40's are, they will have a one up on HOS.

**Although I do not own an original set I was sent pics of original sets by someone who has many.

Very happy with the set and I wish I bought the ebonized too while they had them in stock that first day.  If you buy the Rosewood you should not be disappointed, very dark and rich looking.

i also received my Rosewood Liberty set.

As Mike said the set is perfect.  it is obviously brand new and not a second.

I talked with the manager, Scott, on Monday and he told me that they are phasing out a number of sets to make room for newer stuff.  These half price sets are what they are getting rid of.  There are 7 sets in total, Liberty, Renegade, Fischer-Spassky, Professional, Margate, New York and Windsor.  They now have the Renegade and New York in the Premium or Elite versions too.

They are also giving the one year warranty so they will provide replacements for the year.

Of course the Liberty set is quite rugged.  I have owned one for over 14 years and it wears like iron.

I just bought this one because I could not pass it up at that price and if they are not going to produce any more of them I wanted to have a new one.

By the way, the Rosewood on this set is superb.
