Draws and losing by time

chess.com does not recognize threefold repetion draws. It seems quite unfair to me losing by time in a situation like the one bellow (the game had been like that for awhile). Even more unfortunate is that other users pretty much always refuse draw offers when they are at a time advantage, sometimes even if there's more than a minute or so to play.

If you've done this before, it does not make you a better chess player, quite the opposite. In the meanwhile, is there any reason chess.com does not implement threefold repetition recognition?

It does recognise them. If they occur, press the draw button and the game will be drawn. They are not automatic.

Just like in over the board games, you have to claim the draw before you get the draw.

I did claim it. Maybe threefold repetition wouldn't apply in this game. But, in this case, it would be quite easy for any of the parts to avoid it. Just keep moving the king into different positions every time. Even though this is a clear draw, don't you think?

I though it didn't recognize. In that case, do I have to claim it in the repeting move? Would a claim in the following moves still work?
