Look at the position after 35..Qg3+, 37..Qg3+ and 39..Qg3+.

Click on black's 35th, 37th, and 39th move, and you will see the same position with white having the next move. That's a draw.

its not 3 move repitition, but its still 2 pieces going back and forth due to checks
The rule is not "3 move repitition," but rather the POSITION occurring three times with the same player having the move. The position can come about from different moves. This IS a draw.
was playing on chessmaster on xbox and the computer must have messed up... it declared a draw by threefold repetition that wasnt there.... if it is.... I can't see it... can anyone else?
