The white pawns have made six captures, and Black has ten units on the board, so every missing black unit was captured by a pawn. So d5 was vacant before the bishop moved there, the position was dead before the bishop moved, and it moved illegally after the game had ended in a draw.

In the 6th edition of the USCF Official Rules of Chess, rule 14D4 states that the game is drawn when there are no legal moves that could lead to the player being checkmated by the opponent. Either player can claim the draw. If neither player claims the draw, the game continues, so Leither's position is not illegal under USCF rules.
