Chess.com automatically draws a game after 3-fold repetition, why doesn't it use FIDE rules for 5-Fold Repetition instead?
In FIDE you can also request a draw for 3 fold repitition, after 5 fold repitition it is automatic draw

In Live games it's not easy, or sometimes possible, to claim the draw with premoves and potentially low time on the clock. So it was changed to automatic a while back.
It's still a claimed draw in Daily, as far as I know.
At most super GM events there is not allowed to offer a draw before move 30. So if they want to draw, they repeat position 5 times, throwing ostentatious looks at the arbiter and he then has to claim the game as draw according to five times repetition draw rule.

Cc doesn't use fide rules for anything. It's usually Americ*n rules
