If black timed out, it would be a draw here. As far as I'm aware there's no code checking for a forced win in that case.

Force him to take the pawn and if he doesn't take then you have a promotion threat and it is now a draw. Or stalemate him

Over the board games for different reasons, but under both Fide and USCF rules in this case, black timing out would be a win for white.
