Actually proxy servers still contains rights,permissions and restrictions in binary codes very readable to a program administrator and yes they can still be traced.The same way a hacker in the 90's was traced even with his anonymous proxy server approach and pc hopping style (READERS DIGEST). It's just good that the "cheater" is toy-ing around here and not in some government sites. Because no matter where we are, we use lines (copper to fiberoptics to satellite). Military invented this technology and they can work around it.So i believe ERik technically know the Cheater, But if the CHeater did not violate laws here, then he's a free member to play.

I don't believe, by any means, that cheater_1 and erik are the same person. However, I believe that cheater_1 draws enough attention, and amuses enough people in the forums, that erik allows him to stay. He helps chess.com to be successful. As well as this, cheater_1 has not insulted anyone personally, and has not cheated without blatently stating it to the opponent. He has not made a breach in the laws of chess.com.
