perpetual chess to prevent being mated

Hi, to any one with the answer. I'm being checked perpetually without option to mate. I'm 1 move away to checkmate my opponent. Is my opponent allowed to do this? More then 3 times? Is it remise? What is it?

Of course he's allowed to check you repeatedly. After three times, it's a draw. If you don't want to lose on time, just claim a draw.

Thank you moxieman. Although I thaught he has claim the draw after 3 times. What if he doesn't claim it? It feels strange to be on the upperhand, 1 move away from mate and your opponent can only prevent it by this strategy.

Either of you can claim the draw if a 3-fold has occured.

If he can do a perpetual check you do not have the upper hand and are not winning. That is chess !
