this guy has been banned already, he beat me after I flat out blundered my queen, this was on the 19th of October, he started cheating on that date, from the 19th of October til the next day, he won 181 games and lost just 8 in 24 hours, Prior to this date, he had won 33 and lost 36 games.

Not only did chess.com's algorithm take 189 game to detect this cheat, but they also did not refund me any points for the game I lost, I may have resigned after a blatant blunder, but of course given  those stats, he was using an engine anyway.

How in the world does it take almost 200 games to detect a cheat?

they were all played on 19th/20th October, point being, if chess.com doesn't have any kind of automatic cheat detection in place to detect such obvious cheats then we're all screwed, all those people that never even got a ratings refund as well, the fact someone can go almost 200 games without being banned is a big worry regardless of what they can and can't do.

he played around 70 games, and was 875 rating, then a automatic detection system should spot someone up to no good when they suddenly shoot up through the ratings up to 2200

The site does have some automated systems in place but there are millions of games played each day so not every game is going to get checked and it can take time for accounts to get closed with sufficient evidence.

That said, discussions of cheating are not allowed in the general forums. If you would like to discuss, join the following club: https://www.chess.com/club/cheating-forum
