If you select the custom theme in settings, there is an option to upload a photo/picture as your background.

For iPhone same procedure. Select "Use Photo" for the custom theme background.
That is what I'm doing, but it just says "choose photo" and when I click on it it just uses my current background.

If you open the iPhone's Photos app directly, do you see your photos/pictures?

Is there a maximum File Size for the Backhround ?
Because i want to upload a picture that is 2k kilobytes big, and it does not work

Yes, there is. I believe there's a size and dimension limit, though I don't believe it's stated anywhere.
