twice today i have lost a game on time when my opponent had no material to mate with, this of course should be a draw, im assuming this is common on this site but it should be fixed - thanks

You should post links or the final positions.

If this is one of the games here: http://www.chess.com/livechess/game.html?id=56223375

The pawn counts as enough to be mating material, in light of possible promotions.  That could be the misconception.

Phil_A_S

Even without the pawn a mate can be set up for both sides in that game.

mirage, note that in that game, it was black who won on time, and black was the side with a bishop only, without a pawn.

Chess_Lover11

Black can mate with some help from the opponent! Like opponents pieces blocking his own king!!!

ilmago

There are USCF rules that would make this a draw according to insufficient material.

There are FIDE rules which would say this is not a draw because a mate can still theoretically appear on the board.

Right!  I guess without the link to the right game we can't say anything more.
