I thought the draw was declined as soon as the guy being offered the draw made a move without accepting it. That's what's always happened with me.

I have seen this often, but I believe ItsEoin is right. You should be able to move without accepting or declining the draw. I moved right on through 10 draw offers before I even saw them. It is poor tactic ethically. I have noticed the game does not keep track of draws with 3 repititions of the same board.

You have to claim such draws, per FIDE and USCF rules. It's not automatic.
Problem solved, it was an app issue
