website is not responding

I was really upset when I played live chess today! and I'm afraid it will happen again the next time. I've lost a game on time. The fact is that, I can't move my piece because the provider say "the website is not responding" but the timer is continously running!? In this case, who could be blame or I mean, chess.com would be responsible?
