Ermm well if there are other moves that can be made its not stale mate, if theres even 1 pawn that can capture or move forward the game goes on. So its more like 'A stalemate is when no move can be made with out the king checking himself'...
due to the fact that neither side has enough matirial to mate the other is is a draw. it is not a stalemate because whites king can get out of check in his next turn .
It is black to play, and there is no way for black to win. If black decided to take the rook, white could immediately draw by trading the Queens. After 1...Qxc2+, 2.Kxc2 is the only way to draw. 2.Kd4 and 2.Ke3 obviously lose, so there is no way white can win either.
After 1...Qxc2+ 2.Kxc2, the position is drawn, but play would continue as black could still blunder and lose his bishop, whereupon white could mate. After 2...Bxa4+ the game is automatically drawn due to insufficient mating material.

Okay, but running the King around is just running the KIng around. Where do you suggest the winning move to be?
After 1...Qd6+ 2.Rd4 Qg3, 3.Ke4 obviously loses to the skewer, but 3.Kd2, 3.Ke2, and 3.Kc4 are all drawn. Black just doesn't have enough fire power against white's mobile forces, and the centralized white King is in too little danger. Black has the move, but white is up in material. This being the case, if black cannot cause trouble right away due to tactics, chances are that white will be better off, and black will have to play to hold the draw.
More or less,its a draw.
