You did not say they had to attack the king. So the answer to this is 2 legally because anywhere else unless in place of another piece and they are threatening something.
It was a badly worded question.
The Question: "What is the maximum number of non-attacking rooks that may be placed on a chessboard?"
It was worded correctly, you assumed something else.
