TERMS AND CONDITIONS OF USE FOR CHESSFLUX EFFECTIVE DATE: APRIL 24, 2025 VERSION: 1.0 These Terms and Conditions agreement (the “Agreement”) governs your access to and use of ChessFlux, an educational chess club operating primarily through the Chess.com platform and affiliated communication channels. By joining, accessing, participating in, or otherwise engaging with ChessFlux (hereafter referred to as “the Club,” “we,” “our,” or “us”), you (hereafter referred to as “User,” “Member,” or “you”) agree to be bound by the terms and conditions set forth herein in full. If you do not agree to these terms in their entirety, you are expressly prohibited from using or accessing any part of ChessFlux and must withdraw from the Club immediately. 1. Binding Agreement and AmendmentsThis Agreement constitutes a legally binding contract between the User and the Club. It governs all use of materials, communications, interactions, services, and access to any and all ChessFlux offerings, whether public or private, paid or free. The Club reserves the unrestricted right to modify, amend, suspend, or terminate this Agreement, in whole or in part, at any time, for any reason, and without prior notice. Continued participation or use of Club services following the posting of changes to this Agreement shall constitute binding acceptance of such changes. 2. Eligibility and MembershipMembership in ChessFlux is available exclusively to individuals with a valid and active account on Chess.com. By becoming a member, you affirm that you are legally permitted to enter into binding contracts under the laws of your jurisdiction and that you have not been previously suspended or banned from ChessFlux or any related organization. The Club retains sole and final discretion in determining member eligibility, and it may revoke membership at any time, with or without cause, and without obligation of explanation or prior notice. 3. Scope of ServicesChessFlux offers non-commercial, not-for-profit services intended for the promotion of chess education and community engagement. These services include, but are not limited to, instructional content, live and recorded coaching sessions, internal tournaments, forums, chatrooms, and other pedagogical or community features. All services are offered “as is” with no express or implied warranties of any kind, including, without limitation, implied warranties of merchantability or fitness for a particular purpose. 4. Intellectual Property and Use RestrictionsAll intellectual property, including but not limited to training materials, written content, graphics, designs, logos, forums, and tournament structures provided through or by ChessFlux, remain the sole and exclusive property of the Club or its licensed contributors. Users may not reproduce, publish, distribute, modify, sell, or publicly display any proprietary content without prior written authorization from the Club. Unauthorized use may result in immediate termination of membership and may give rise to civil and/or criminal liability under applicable intellectual property laws. 5. Prohibited ConductUsers are prohibited from engaging in any conduct that, in the sole judgment of the Club, is unlawful, unethical, abusive, harassing, defamatory, obscene, fraudulent, harmful, or otherwise disruptive to the Club’s operations, its members, or its reputation. This includes but is not limited to cheating, harassment, impersonation, unsolicited advertising, data scraping, dissemination of harmful content, use of bots or artificial assistance during games, or violation of third-party rights. Violations may result in immediate suspension or permanent expulsion from the Club, and may be referred to Chess.com and/or appropriate legal authorities for further action. 6. Third-Party PlatformsThe Club operates primarily through third-party platforms, including Chess.com and, where applicable, email or video conferencing services. The Club disclaims all liability for actions or omissions by such third-party providers. Users are subject to the terms and conditions of those third-party platforms, which operate independently of this Agreement. The Club is not responsible for the performance, availability, or security of such platforms. 7. Privacy and DataChessFlux does not collect, retain, or disseminate personal data beyond what is publicly visible on a User’s Chess.com profile, unless explicitly authorized by the User in writing. Any additional information submitted to administrators (e.g., application forms, surveys, or coaching preferences) is treated as confidential and used solely for internal Club operations. The Club will not sell or distribute member data to third parties under any circumstances, except where required by law or as necessary for enforcement of this Agreement. 8. Dispute ResolutionIn the event of a dispute between a User and the Club, the User agrees to first engage in good-faith mediation with a designated Club administrator. If the dispute remains unresolved, the Club reserves the right to make a final and binding decision. This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Club owner resides, without regard to conflict of law principles. Any legal claim or action arising out of this Agreement must be brought exclusively in the appropriate courts located in that jurisdiction. 9. Limitation of LiabilityTo the fullest extent permitted by law, the Club, its owners, administrators, and affiliates disclaim all liability for any direct, indirect, incidental, consequential, special, or punitive damages, including loss of data, interruption of service, personal injury, emotional distress, or loss of reputation resulting from or in connection with the use of ChessFlux. The User agrees that the total cumulative liability of the Club, for any claim whatsoever, shall not exceed zero dollars ($0.00), regardless of the nature of the claim. 10. TerminationThe Club may, in its sole discretion, suspend or permanently terminate a User’s access to ChessFlux without prior notice, for any reason or no reason, including but not limited to a violation of this Agreement or the Club's Code of Conduct. Upon termination, the User agrees to cease all use of Club content and services, and any privileges or entitlements will be forfeited with immediate effect. 11. Entire AgreementThis Agreement, including all referenced policies and supplemental materials (e.g., ChessFlux Code of Conduct), constitutes the entire agreement between the User and ChessFlux with respect to its subject matter and supersedes all prior and contemporaneous understandings, communications, and agreements, whether written or oral. If any provision herein is found to be unenforceable, the remaining provisions shall remain in full force and effect. By joining or continuing to participate in ChessFlux, you affirm that you have read, understood, and agreed to these Terms and Conditions in full. If you require clarification or seek permission for specific uses of Club content or services, please contact the Club Owner or a designated Super Administrator.

ChessFlux Official Rules & Code of Conduct Welcome to ChessFlux, a community built on respect, learning, and shared passion for the game of chess. To ensure an inclusive and focused environment for all players and learners, we ask that you read and adhere to the following club rules. 1. Advertising Policy Advertising of any kind is strictly prohibited without prior approval. This includes, but is not limited to:- Unsolicited links to blogs, clubs, Discord servers, Twitch streams, YouTube channels, or social media accounts- Promotion of services, events, or external communitiesIf you are a chess coach, content creator, or club owner and wish to share or promote your content in any form, you must first obtain permission from the club owner. You may request to be listed on the club's official coaching forum or inquire about a partnership.Repeated violations of this policy may result in a mute or permanent ban from the club.2. Anti-Cheating PolicyWe have zero tolerance for cheating in any form.All suspected cheating is handled by Chess.com automated detection system.If you believe a player has violated fair play policies, please use the Chess.com report function directly.ChessFlux does not conduct its own investigations, but we fully support and cooperate with the platform's anti-cheating measures. 3. Conduct & Communication Respectful communication is a cornerstone of our community.The following behaviors are not allowed:- Spamming of any kind (including requests for admin status)- Abusing forum features or posting meaningless content- Public accusations, slander, or calling out other members- Rude, aggressive, or abusive language (including swearing or abbreviations of profanity)- Impersonating other users or admins- Harassment of any kind, whether in forums, notes, messages, or gamesIf you are interested in joining the admin team, please fill out the official Admin Application Form (linked on the club homepage), or contact a Super Admin directly.If you feel mistreated or disrespected, please reach out privately to a Super Admin. Do not attempt to moderate or correct others publicly allow administrators to manage rule enforcement. 4. Prohibited Topics To maintain a family-friendly and focused environment, discussion of the following topics is not permitted:- Politics, religion, or other controversial real-world topics- Any form of illegal activity- Self-harm or sensitive mental health issues- Violations of these rules will be handled on a case-by-case basis, with appropriate consequences ranging from a warning to a permanent ban. 5. Sportsmanship & Behavior During Games All club members are expected to demonstrate good sportsmanship, especially during live events and tournaments.Friendly chat is allowed, but unsportsmanlike behavior will not be tolerated.Mocking, rage quitting, or rude messages will result in disciplinary action.We encourage healthy competition, learning from mistakes, and supporting one another's growth. 6. Spam & Mass Invites You are welcome to share the ChessFlux club with friends and like-minded players, but please do so respectfully.- Do not spam our club link in other users' inboxes, forums, or club notes- Do not create troll or duplicate accounts, especially in ways that may harm the club's reputation or functionality- Mass invitations that may be interpreted as spam are strictly discouraged. 7. Warning System & Enforcement ChessFlux uses a tiered warning and penalty system based on the nature of the rule violation:- Minor Offenses may result in a verbal warning or short-term mute- Major Offenses may result in temporary suspension or longer muting- Severe or repeated violations may result in a permanent banThe exact penalties are determined at the discretion of the Super Admins, who may act outside of the general guideline if deemed necessary for community well-being.
