If you are talking about this game: http://www.chess.com/livechess/game.html?id=42090485 then it may have appeared that you never disconnected while your opponent's time ran out. This is a known bug, and the chess.com staff is working hard to correct it.
play 2 game. player w higher rating losing, time out but i get the lost
