a variant of chess where all pieces can be on either side. For the gamblers that risk a chance of automatically losing.

In this case, black wins because the first move needs to be 1. Kxb1 and so after that would most likely come 1. ..Rxc1 2. Kxc1 Qxe8 3. g3 Bg2 4.Nf3 Bxh1 so it is definitely for the risk takers! (also could start with 1. Qxb1)

I suppose positions with both kings in check are ruled out?

king next to king yes, both kings in check by regular pieces no, somthing like white in check by a queen on b1 and black in check by a rook on c8 could go 1. Kxb1 Kxc8 (taking the king when both r in check would be illegal)
