As much as I am against public accusations in the absence of, or even in advance of, an official declaration by chess.com, in this case that declaration was made and only the label removed upon threat of legal action. The account remains closed, and the reasons for it well known. I think that declaring this user a cheater is entirely fair game, however it should probably be done in the cheating discussion group, not here.
