Chess.com really should change their rules. Totally unfair for the white side.
Chess.com doesn't need to "change its rules".
With Black to move, if this position really comes up as a draw then chess.com doesn't understand the laws of chess or doesn't have the programming skills necessary to take care of mates with K+p against K+N.
