Why is it a draw and not a win?
No legal move and king is not attacked = draw
No legal move and king is attacked = win/loss
In the position White has no legal move and the white king is not attacked.
Stalemate because white has no legal moves and is not in check at this time.
I see that quen moved from A2 to a1 normally while quen at A2 White King could not be at h2 :cool

It was declared back in 1884 By K4cpr index that that position is a draw.
It's called stalemate.
The enemy king is not under attack, but has no legal moves to make. The king cannot go to any square without being taken, and no other piece on the board can move.
