Yeah, b8=(black)N# is a mate in one.
Maybe it could be possible to promote to a different color piece, but when would anyone ever want to do it? This kind of position never really happens anyways.
And, even if it were to occur, white still has a clear forced mate in 3. But, I see his point. Clever. =D
