It's against the rules to use it in live chess, it is perfectly legal to use it in the online correspondence chess.

Would it be considered cheating using the chess.com game explorer database during a game your playing? Haven't done this yet due to ethics, but wondered what you guys think? More experienced player have game analysis stored in memory to turn to for help during a game, its not the same I know, but for those of us who cant commit that much brain space to memorizing games, this could be useful for learning. Discuss...
