Are chess positions copyrighted?

Someone gave me a position that they wanted analyzed for a youtube video can I use that? What are the rules behind it.

No. Chess positions and game scores are not copyright protected.

Yes I believe Chess moves are ‘public domain’ like singing Happy Birthday or doing the Hokey Pokey. (I don’t care what anyone says… it’s the Hokey ‘Pokey’ not the effing Hokey ‘Cokey’… The latter is something else entirely I did several times on my visit to Peru.

I think you cannot copy the exact annotations of chess book authors. And claim it that it is your own. Same positions maybe it is ok. I am not sure though.

Bobby Fischer argued that chess games should be copyrighted, and so also single positions. Fortunately for us all chess positions still remain in public domain. I think however that the author of a chess problem should be always mentioned in publications, not for legal reasons, but to honour his work.

What is certainly copyrighted are the comments to positions. If you use extensively commented of a game for a publication you can get in trouble.

And I would be reluctant to use exactly the same positions of a book for an own publication, even if the comments would be different.

Bobby Fischer never argued chess games should be copyrighted, that was Emmanuel Lasker. 

I don't see any reason at all why games and positions shouldn't be copyrighted - if we're going by standard copyright then they would be copyright by default. The idea that chess moves and positions shouldn't be copyrighted is the radical idea here, not that it should.

From what I understand they are not copyrighted. But, in some instances they might be. For instance it might be possible a person (professional) playing a game of chess at a venue (or their game reproduced at a venue) could fall under PRO jurisdiction. If a venue (probably private and not public) were to benefit from that game or reproduction it seems like there could be a PRO issue. I doubt a chess game, whether live or reproduced, has ever been the subject of a PRO court case but I don't see why it couldn't. 

It seems to me that's a really good question, as a PRO case is only for copyrighted material. Which chess games are not. BUT, if the performer (a chess player) has his work benefitting someone else and he is not compensated I don't see why such a suit could not be brought. I could be missing something though, I'm not a lawyer.

Ok, you are telling me that you know exactly what Bobby Fischer said and what not? Bobby Fischer was one of the guys who said that chess games should be copyrighted, and he was not the only one. They argued that a chess game is the product of creativity, as written a song or a novel.

By the way, it seems superficially that Bobby Fischer was obsessed by making money. However, money was not important for him at all. He was always concerned that other people would make money at his costs, or that other people would make more money than him (for example, that a box fight would generate more money than a chess match).

BTW, if you google are chess games copyrighted you will find a lot of good information.

Fischer expressed many times his opinion on the topic.
See for instance what he wrote about this in November 2, 1975 in a letter to congressman Robert W. Kastenmeier: “I feel quite strongly and have so for many years, that chessplayers should have copyright protection for their chess games”.
