In my opinion the only unfair aspect of paid membership is that they are automatically protected from time-outs in daily games.
Membership should include training and learning material, that is totally reasonable, but it shouldn't include advantages that can affect rating. But whatever, it's only happened to me once where a paid member took about a month to time out in a 3-day game. Not really a big deal, just annoying.

Obviously, OP, you are entirely unfamiliar with how the world works.
When you look at the value received it really isn't a bad deal. In addition to the tactics and other benefits, it also helps support the site so that so many people (like the OP) are able to play for free. I upgraded because 5 tactics a day wasn't enough for me either.
If you look at the lowest cost membership option (Gold, $29/yr.) the cost is a mere $0.08 per day and just $0.003 per tactic. 
If there wouldn't be a difference, there would be no desire to upgrade.
If you want all the fancy stuff out there you have to pay for the bang, if you want to play chess and open senseless threads then there's no need to pay.

Get the diamond membership today and you can do what you love doing, doing tactics, all day long, no limit. Wouldn't that be great? There's a likely discount, imho at the moment 0% but better than nothing!

Yes its fair. If someone is paying to help support chess.com they should be able to have more fringe benefits. I dont believe they should be given preferential treatment, but they should defintiely get perks.
Now if youre a firm believer in welfare, and that you have a right to not contribute, and its the responbility of everyone to support you, then i get where youre coming from.
This isnt the only site you can do tactics.

You have access to hundreds of lessons, for free.
You have the ability to access and create posts in any of the several forums here, for free.
You have access to a number of video lessons, for free.
You have access to a mobile app that allows you to utilize all of the above while away from a computer, for free.
You have access to the nearly 1,800 videos on the YouTube channel, for free.
You have access to polite and punctual customer service to help you with any problems you might encounter when utilizing any of the above services, for free.
And i'm probably forgetting a couple of other things that are also available...for free.
What other things that take money, effort, competence, and hard work to produce do you think you deserve for free?
