Draw or win?

1) If White has K+N and Black has K+B and black's flag falls, is it a draw or a win for White, since White can legally construct a mate, or does the "normal means" rule still apply? (the Fide rules seem to imply that a "normal means" claim must be made before time expires.)

2) What if Black's last move was BxP, meaning that the "normal means" rule didn't apply when the game was live, but could apply after time expired? Does the answer change based on whether a draw claim was already submitted and/or an arbiter is watching the game?

I think it's counted as a draw. But I might be wrong
