Whenever you lose a game to a player who got banned for fair play reasons you get a refund, and I recently faced a player who got banned for fair play violations. After he got banned i didn't get my rating points back.
Also I am 100% certain that during the game I played against the person in question was not playing under the same circumstances as me.
